of continuing tax breaks for the wealthy, the obama administration is willing to go over this cliff which means they're willing to let your taxes go up and unemployment checks go away massive spending cuts happen if the pentagon instead of continuing the tax breaks for the wealthy. now there's been very little progress here on chiapitol hill which is why so many have gone home. we know that president obama and john boehner spoke by phone. republican sources telling us they had a conversation yesterday. we don't have a readout on what that was about. we don't know that if any meetings have been scheduled. but any small sign of progress is welcome here on capitol hill. now with so many lawmakers headed home and likely to face the ire of their constituents, we saw one protester in baltimore yesterday over social security. there are a few left. today there's a joint economic committee hearing. they're going to hear from a top economist not only about the jobs numbers coming out tomorrow but also about what can be done to avoid this issue at the end of the year. >> tracie potts for us in washington.

for citizens to petition the obama administration to take action on issues that they find very important to themselves. the the site makes civic engagement easy and has sparked some interesting causes. and its policy of issuing a response if a petition gathering 25,000 signatures in 30 days has caught the attention of the internet trolls. it was the forum used by over 100,000 texans to secede from the united states, which resulted in another petition to withdraw. anything can happen. you can see where this is going. but there's one petition on the site that we here at "the ed show" can certainly get behind. it's a substantial stimulus project that would create millions of jobs, boost america's steel industry, got to love that, expand our space program, and basically guarantee our national security. what could be better? someone has petitioned the administration to build a death star. the fictional moon-size space base capable of destroying entire planets from "star wars." just under 2,000 people have signed the petition to ask president obama to secure the resources to construct a death

marijuana law, the obama administration is considering ways to crack down on the reforms. top officials are looking at how to use the federal government to reverse the impact of the new laws, according to a report in "the new york times." now the options include denying federal grants to states that legalize pot, aggressively prosecuting pot users in those two states under the federal laws, or most controversially, just taking these states to court. then the administration could get a formal ruling that the federal laws against pot just cancel out these new state laws. all those proposals are premised on fighting against the new politics and spirit that has been take hold in these states. but the obama administration could also embrace this as a moment to rethink the entire drug war. it could ask congress to at least lower marijuana's current classification as a schedule 1 substance. that is the anachronistic and grave category for drugs like heroin, which have no prospect of safe or medical use. or look, the administration could do for pot what it did for children of undocumented worke

is the obama administration going to do? >> the president has been clear he's against legalization. we know we are going to have a cheaper drug, more people are going to use it. it's going to be more socially acceptable. it's a problem in one in six kids. it can be a problem on the roads and learning iq. the administration is against it. what the justice department does because they have ten different legal things they are trying to do. that's the more interesting question. federal is federal law. i can't imagine the administration is going to say they are okay with retail sales. you might be able to have people grow their own. i think if the governor of colorado was right to say not to break out the cheetos just yet. a lot needs to be ironed out here. >> the studies and negative consequences. there's a lot of interesting gain on this. there's data with no effect. some that finds some negative facts depending on when kids smoke it. it has to be compared to alcohol. in some ways, that becomes a big issue. there's lots of negative effects of alcohol. >> it's legal because of a cultural history.

in recess. the obama administration says, no. the sessions are a sham. they last less than a minute. the congress or the senate when it decided to do this passed an order saying that no business would be conducted during these pro forma sessions. what are more do you need? the senate says we'll decide whether we're in recess or not and we say we're not, and not only that in the early part of the recess from december of last year to january of this year, the senate actually passed an extension to the payroll tax cut. so is the senate in recess or not? and this is it either going to go to the supreme court, chuck, or the courts are going to say, you know what, we can't -- this is a dispute between the political branches. you guys work it out. i don't think it's 100% clear whether the courts will decide they can decide this question. >> that seems odd. i want to throw up a graphic. obama has actually done fewer, 32. he had fewer opportunities. bush 43 did 99. clinton 95 of them. isn't this destined for the supreme court? if you have the legislative branch and the executive branch disag
